SC started hearing on a petition filed by about 76 linguistic / religious minority medical colleges pleading for exemption from NEET.
A bench comprising Chief Justice Altamas Kabir and Justices S S Nijjar and J Chelameswar on Tuesday were told by the minority medical colleges that enforcing the national eligibility cum entrance test (NEET) is in violation of Article 30 of the Constitution vide which they are entitled for autonomy in administration of their educational institutions.
Meanwhile, Christian Medical College, Vellore, was allowed to receive applications for its own entrance examination for filling MBBS seats, on October 10. This interim order allowing minority education institutions to receive applications from candidates for an individual entrance test for filling their respective under-graduate medical seats was extended to all colleges which have now approached the apex court invoking Article 30. But after hearing the counsel of Medical Council of India (MCI), the court had put a caveat saying “will not entitle the respondent institution to claim any equity on the basis thereof”. The caveat means, if the colleges lose the legal battle in the apex court, then they cannot claim a right to hold separate examination on the ground that they have already received applications from candidates.
National Eligibility cum Entrance Test (NEET) has been prescribed for admission to under graduate medical and related courses conducted by all the medical colleges in the country. The online registration for the test is already underway since 1 December 2012 and the NEET 2013 will conducted on 5th May 2013.
