One hundred seventeen medical students, who were granted admission in a private medical college in violation of law, were on Thursday directed by the Supreme Court to pay Rs 3 lakh each to the government. The court also directed the Geetanjali Medical College and Hospital in Udaipur in Rajasthan, which was responsible for making the admissions in violation of MCI regulations, to surrender 107 seats in a phase-wise manner which will be filled up by the students selected through common entrance test conducted by the state government.
The SC bench of justices A K Patnaik and Swatanter Kumar however refused to cancel their admission which was done in 2008. It however directed that the amount would be used for improvement of infrastructure and laboratories in government medical colleges.
“We hold that each of the 117 students who have been admitted in the MBBS seats in the college will pay Rs 3 lakh to the state government on account of their admission in violation of the MCI regulations and the total amount received by the state government from the 117 students will be spent for improvement of infrastructure and laboratories in the government medical colleges of the state and for no other purpose,” the bench said in its order.
“The college which was responsible for making the admissions in violation of MCI regulations will surrender 107 MBBS seats to the state government phase wise, not more than 10 in any academic year beginning from the academic year 2012-2013 and these surrendered seats will be filled up by the students selected in RPMT or any other common entrance test conducted by the state government,” the bench said.
